MonetiseU programme terms

These Terms & Conditions apply to your purchase of and participation in MonetiseU, provided by Live It Up Lifestyle Pty Ltd (“we”, “us”, “our”).
By purchasing MonetiseU, you agree to these Terms & Conditions. Please read them carefully before completing your purchase.
1. ABOUT MONETISEU
MonetiseU is a live educational and coaching programme designed to help participants develop and build an online offer around their existing knowledge, experience and expertise.
The programme may include live coaching and training calls, recorded training, digital resources, templates, tools, community access and other educational materials.
The exact inclusions, programme dates and delivery format will be those described on the relevant sales or checkout page at the time of purchase.
2. EDUCATIONAL PURPOSE ONLY
All information, training, coaching, resources and materials provided through MonetiseU are for general educational and informational purposes only.
Nothing provided through MonetiseU constitutes financial, legal, tax, accounting, investment or other regulated professional advice.
You are responsible for obtaining independent professional advice where appropriate for your individual circumstances.
3. NO GUARANTEE OF INCOME OR RESULTS
We do not guarantee that participating in MonetiseU will result in any particular financial, business, audience, sales or other outcome.
Any references to revenue, income, sales, audience growth, business results or other outcomes achieved by Emily, previous clients, students or other individuals are provided as examples only.
They are not a promise, guarantee or representation that you will achieve the same or similar results.
Your results will depend on many factors outside our control, including your existing skills and experience, the quality and demand for your offer, your audience, positioning, marketing, pricing, implementation, consistency, effort and individual circumstances.
Building and growing a business involves risk. You acknowledge that purchasing MonetiseU does not guarantee that you will make money or recover the cost of your investment.
You remain solely responsible for the decisions you make and actions you take in relation to your business.
4. YOUR RESPONSIBILITY
MonetiseU provides education, guidance, tools and support, but you are responsible for implementation.
By purchasing the programme, you acknowledge that results require your active participation, decision-making, implementation and effort.
We cannot be held responsible for results you do or do not achieve as a result of participating in the programme.
5. PAYMENTS
You agree to pay the price displayed at checkout at the time of purchase.
If you select a payment plan, you agree to pay all instalments in accordance with the payment schedule presented at checkout.
A payment plan is a payment arrangement for the full programme fee, rather than a month-to-month subscription that can be cancelled at any time.
If a scheduled payment fails, we may temporarily suspend access to MonetiseU, including programme materials and community access, until the outstanding payment has been resolved.
You remain responsible for any outstanding instalments you agreed to pay at the time of purchase, subject to applicable law.
6. REFUNDS & CANCELLATIONS
Due to the digital nature of MonetiseU, the immediate provision of digital resources and programme access, and the limited places available in the live cohort, we do not provide refunds for change of mind or because you decide not to participate, complete or implement the programme.
Please consider the programme carefully before purchasing.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law.
Where you are legally entitled to a remedy, these Terms do not affect that entitlement.
7. PROGRAMME ACCESS & LIVE SESSIONS
You are responsible for attending live sessions and making use of the programme resources provided.
Where recordings are made available, their availability does not guarantee that every session or interaction will be recorded or permanently accessible.
We may make reasonable changes to session times, programme delivery, resources or other operational aspects of MonetiseU where necessary.
If changes are required, we will make reasonable efforts to communicate material changes to participants.
8. INTELLECTUAL PROPERTY
All MonetiseU materials, including but not limited to videos, recordings, training materials, frameworks, templates, worksheets, calculators, prompts, resources, presentations, written content and other programme materials, remain our intellectual property unless otherwise stated.
Your purchase gives you a limited, personal, non-exclusive and non-transferable right to use the materials for your own personal and business education.
You must not copy, reproduce, distribute, sell, licence, share, publish, upload, teach, commercially exploit or otherwise make the programme materials available to another person without our prior written permission.
Your access is for one participant only unless we have expressly agreed otherwise.
9. COMMUNITY & PARTICIPANT CONDUCT
We want MonetiseU to be a supportive and respectful environment.
You agree not to harass other participants, engage in discriminatory or abusive behaviour, spam or solicit participants without permission, share another participant's confidential information, or otherwise behave in a way that materially disrupts the programme or community.
We reserve the right to remove a participant from the community or programme for serious or repeated breaches of these standards.
Where permitted by law and appropriate in the circumstances, removal for misconduct does not automatically entitle the participant to a refund.
10. CONFIDENTIALITY
During MonetiseU, participants may share information about their businesses, ideas, offers, finances or personal circumstances.
You agree to respect the privacy of other participants and not share confidential or sensitive information disclosed within the programme or community outside of MonetiseU without that person's permission.
11. LIVE CALLS & RECORDINGS
Some MonetiseU sessions may be recorded and made available to other programme participants.
By participating in a recorded session, your name, voice, image, questions or contributions may appear in the recording.

Programme recordings are intended for participant access and may not be downloaded, reproduced or distributed unless we expressly permit it.
12. TESTIMONIALS & CASE STUDIES
We will not use your name, image, testimonial or identifiable results in public marketing without the permissions required by applicable law.
If you separately agree to participate in a testimonial or case study, the scope of that permission may be set out in a separate written consent.
Any testimonials or case studies we share represent the experience of the individual concerned and do not guarantee that another participant will achieve the same result.
13. THIRD-PARTY PLATFORMS & TOOLS
MonetiseU may refer to or use third-party platforms, software and services.
We do not control third-party providers and cannot guarantee their ongoing availability, functionality, pricing, policies or performance.
You are responsible for reviewing and agreeing to the terms and privacy policies of any third-party services you choose to use.
Unless expressly stated otherwise, the cost of third-party software, subscriptions, advertising or other business expenses is not included in your MonetiseU purchase.
14. PRIVACY
We collect, use and store personal information in connection with your purchase and participation in MonetiseU.
This may include information required to process your purchase, provide programme access, communicate with you, administer the programme and meet our legal obligations.

Payments may be processed by third-party payment providers, which process payment information in accordance with their own terms and privacy policies.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for indirect, consequential or special loss arising from your participation in MonetiseU or your reliance on programme materials, including loss of profits, revenue, business opportunities or anticipated savings.
You remain responsible for your own business decisions, implementation, expenses, offers, marketing and activities.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any rights or remedies that cannot be excluded under applicable consumer law.
16. EVENTS OUTSIDE OUR CONTROL
We are not responsible for delays or interruptions caused by events reasonably outside our control, including significant technology failures, internet outages, illness, natural disasters, government restrictions or failures of third-party platforms.
Where such an event materially affects programme delivery, we will take reasonable steps to provide an alternative arrangement where practicable.
17. CHANGES TO THESE TERMS
We may update these Terms & Conditions from time to time.
The terms applicable to your purchase will generally be those made available to you at the time you purchased, except where a change is required by law or otherwise lawfully applies.
18. GOVERNING LAW
These Terms & Conditions are governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them, subject to any rights you may have under applicable consumer law.

20. SMS communications
Live It Up Lifestyle Pty Ltd provides the MonetiseU SMS service. If you opt in, we may send event or masterclass confirmations and reminders, programme information and service updates. Promotional messages about MonetiseU and related offers will be sent only where you have consented to receive them.
Providing your phone number or purchasing a programme does not, by itself, enrol you in marketing text messages. Agreeing to marketing messages is optional and is not a condition of purchase.
Message frequency varies according to the events, services and communications you sign up for. Your mobile provider may charge for messages and data, including replies to us.
To stop SMS messages, reply STOP to a message from us. We may send one final confirmation of your opt-out. Further SMS messages will stop unless you opt in again.
For help, reply HELP or email [email protected]. If you wish to rejoin, complete the opt-in process again.
Mobile carriers are not responsible for messages that arrive late or are not delivered. Delivery depends on your network and service availability.
